π Check Your Trademark Renewal Deadline
Why Trademark Renewal in China Is Critical
A registered China trademark is valid for 10 years from the registration date. Unlike some jurisdictions, China does not have a post-registration maintenance filing, but you must file a trademark renewal application before the expiry date. Failure to renew on time results in automatic invalidation, leaving your brand vulnerable to squatters. Under Chinese Trademark Law, you have a 12-month grace period after expiry to file a late renewal with an additional surcharge. After the grace period, the trademark is permanently cancelled, and you would need to file a new application from scratch β which could be rejected due to prior identical or similar marks filed by third parties.
β οΈ Critical deadline reminder: CNIPA does NOT send automatic renewal reminders to foreign owners. We monitor your trademark portfolio and send proactive alerts 6 months before expiry. Contact us to register your trademarks in our monitoring system β free of charge.
China Trademark Transfer & Assignment
Trademark transfer China (also called trademark assignment) is the legal process of transferring ownership of a registered trademark from one entity to another. Common scenarios include:
- Acquisition or merger of a company that owns China trademarks
- Sale or licensing-back of intellectual property assets
- Transfer from an individual to a newly formed company
- Assignment as part of a brand portfolio restructuring
- Recordal of change of name (e.g., company name change without change of legal entity)
Our trademark assignment China service includes: drafting or reviewing the trademark assignment agreement, preparing the application for recordal with CNIPA, submitting proof of assignment (e.g., deed of assignment), and obtaining the official approval and updated registration certificate. We also handle change of name/address filings when the trademark owner's legal name changes but ownership remains the same.
π Important: Under Chinese practice, an assignment of a registered trademark will not be approved if it is likely to cause confusion or misidentification (e.g., assigning a trademark used for similar goods to different entities). We conduct a pre-assignment check to ensure successful recordal.
Timeline & Costs for Renewal and Transfer
Trademark renewal China timeline: Once we file the trademark renewal application with CNIPA, the renewal certificate is typically issued within 1 to 2 months. There is no substantive examination for renewal; it is a formality check provided the trademark is still registered and the application is timely.
Trademark transfer China timeline: CNIPA examines the assignment application for about 4 to 6 months. If approved, the assignment is recorded, and a new registration certificate in the assignee's name is issued. During the assignment pendency, the trademark remains registered under the assignor's name.
Official fees: CNIPA renewal fees depend on whether filing within the standard period or late renewal with surcharge. Transfer/assignment fees are fixed per class. Our service fees are transparent and fixed β no hidden costs. Contact us for an exact quote based on your trademark portfolio.
